As per state law, all ordinances and resolutions are adopted by the Town Council in an open meeting.  As part of an open discussion, all ordinances and resolutions are presented to the Council in their draft form to receive input from the Council and public before they are adopted officially in ordinance or resolution format.  Some ordinances require a public hearing be held prior to the adoption.

Ordinances which pertain to the regulation of the public are identified in the Brian Head Town Code as law for the local municipality.  Not all ordinances are in the Town Code, such as budget proposals, meeting schedules, etc. 

Resolutions are not codified in the Town Code and instead remain as standalone adopted records, such as budget adoptions, fee schedules, interlocal agreements, and board appointments.

For a copy of any of the ordinances, contact the Town Clerk and request a copy.  All ordinances & resolutions are classified as public records.

2026 Adopted Ordinances

  • Ordinance No. 26-001 - Town Code, Title 9 Land Management Code, Chapter 2 Definitions and Chapter 7 Zone District Regulations.  Adopted February 10, 2026

  • Ordinance No. 26-002 - Confirming the assessment list and levying an assessment against properties withing the Brian Head Unit 3 Special Assessment Area (SAA) for the purpose of financing certain improvements within the assessement area.

  • Ordinance No. 26-003 - Confirming the assessment list and levying an assessment agains properties within the Elk Drive Special Assessment Area (SAA) for the purpose of financing certain improvements within the assessment area.

  • Ordinance No. 26-004 - Amending the Town Code, Title 9 Land Management Code (LMC) Chapter 7.13 Zone Designation Regulations from Aspen Meadows Mountain Overlay Zoning District to Aspen Meadows Mountain Zone.

  • Ordinance No. 26-005 - General Plan Land Use Map Amendment, changing the Annex Transition to Aspen Meadows Mountain.

  • Ordinance No. 26-006 - Amending the Land Management Code (LMC) Chapter 6 Zone District Map changing the zone designation from Annex Transition to Aspen Meadows Mountain Zone.

  • Ordinance No. 26-007 - Blue Way Jay partial road dedication.  An ordinance dedicating a portion of Blue Jay Way to the Town of Brian Head and connecting the road to Granite Court.

  • Ordinance No. 26-008 - Adoption of a revised Public Works Standards for Construction Manual.

  • Ordinance No. 26-009 - Fiscal year 2027 Budget adoption.

  • Ordinance No. 26-010 - Fiscal year 2026 Budget amendment for June 30, 2026.

  • Ordinance No. 26-011 - Amending the Land Management Code, Chapter 7.4 Zone District Regulations for General Commercial.

  • Ordinance No. 26-012 - Amending the Land Management Code, Chapter 7 Zone District Regulations for establishing Section 7.14 Mixed-Use Overlay Zone.

  • Ordinance No. 26-013 - Amending the Land Management Code, Chapter 4.B.5 Submittal Requirements for Mixed-Use Overlay Zones.

  • Ordinance No. 26-014 - Amending the Land Management Code, Chapter 12.5(C).6, Design Guidelines for Construction for fencing.

2026 Adopted Resolutions

  • Resolution No. 26-563 - Appointing the Board of Equalization for the Elk Drive Special Assessment Area.

  • Resolution No. 26-564 - Appoint the Board of Equalization for the Brian Head Unit 3 Special Assessment Area.

  • Resolution No. 26-565 - Authorizing Council Member Duane Nyen to automatically succeed to the position of Mayor Pro Tempore and Council Member Larry Freeberg as back up for the same position for the governing body of Brian Head Town.

  • Resolution No. 26-566 - Amending the Code Compliance Administrative Policy.

  • Resolution No. 26-567 - Establishing the terms and conditions for the issuance of the Town’s not to exceed $777,273 Special Assessment Bonds, Series 2026 (Brian Head Unit 3 SAA) and authorizing the execution of a Master Resolution, A Bond Purchase Agreement and other documents required in connection therewith.

  • Resolution No. 26-568- Establishing the terms and conditions for the issuance of the Town’s not to exceed $323,437 Special Assessment Bonds, Series 2026 (Elk Dr. SAA) and authorizing the execution of a Master Resolution, Bond Purchase Agreement, and other documents required in connection therewith.

  • Resolution No. 26-569 - Adopting the tentative budget and tentative property tax impact schedule and calling a public hearing.

  • Resolution No. 26-570 - Receiving statement of intent from the Budget Officer regarding the tentative budget, proposed property tax increase, and proposed property tax impact schedule.

  • Resolution No. 26-571 - Intent to increase property tax revenue and calling a public hearing for Truth in Taxation.

  • Resolution No. 26-572 - Declaring the Town Council’s intent to consider adoption of a Transportation Utility Fee and calling a public hearing.

  • Resolution No. 26-573 - Adopting the Fiscal Year 2027 Strategic Plan.

  • Resolution No. 26-574 - Approving an interlocal agreement between the Brian Head Community Development and Renewal Agency and Brian Head Town regarding the Community Development Project Area in Brian Head.

  • Resolution No. 26-575 - Electing to formally pick up the employee contributions of 5.98% required to be paid under Utah Code Annotated Section 49-23-301(2)(c), as enacted by Senate Bill 56, with public safety and firefighter tier II retirement enhancement.

  • Resolution No. 26-576 - Adopting fiscal year 2027 Consolidated Fee Schedule.

  • Resolution No. 26-577 - Amending the Special Assessment Area Policy.
